General contracting procedure
The contracting procedure can only be carried out in Spanish. If it can be carried out in another language, this will be indicated before starting the contracting procedure.
In order for the contract for the purchase of products in our store to be valid, the order information provided by the user must be accurate, complete and up to date at all times. Failure to do so constitutes a violation of the terms, which may result in the termination of the contract with UnicornioH .
Purchase validation
Once the purchase has been made, UnicornioH will immediately send the user an order confirmation by email. If the customer does not agree with the data entered in said confirmation, they may request that the data be modified or the order be cancelled .
In any case, the corresponding communication regarding cancellation or modification must be made within seven business days from the confirmation of the order, via email to administracion@unicornioh.es and provided that the order has not been shipped.
Prices
The prices applicable to each product are those indicated on the website on the date of the order. Prices are expressed in euros (€) and include the applicable VAT (Value Added Tax) in Spain.
However, in accordance with the provisions of Law 37/1992, of December 28, on Value Added Tax , the transaction may or may not be subject to said tax depending on the country of residence of the buyer and the condition in which he or she acts (businessman/professional or individual).
Consequently, in some cases the final price of the order may be altered with respect to that shown on the website.
The invoice is issued upon shipment and is accessible and downloadable from the user account, as well as being sent in PDF format in the shipping confirmation email.
Validity of prices and offers
The products offered on the website, and their prices, will be available for purchase as long as they are displayed and can be viewed through the website.
Users are kindly requested to access updated versions of the website to avoid pricing errors. In any case, orders in process will maintain their conditions for 7 days from the time of their formalization.
Payment methods
The user/buyer agrees to pay for the products purchased from UnicornioH using the accepted payment methods and for any additional amounts (including taxes).
UnicornioH accepts the following forms of payment:
- Credit and debit card.
- This payment method does not confirm the order until the amount has been received in our account.
Once the purchase has been made, a confirmation of the purchase made will be sent to the email address indicated, which will serve as proof of the operation "Proof of purchase", together with a link to these general purchase conditions, as well as to the returns policy.
The confirmation of the contract and its receipt will not be valid as an invoice that will be sent when the order is shipped.
Delivery conditions
All items in our store indicate whether they are in stock or not when you choose their attributes. If all the items in your order are in stock and if the order has been confirmed and paid for before 2:00 p.m., we will do our best to ensure that it is shipped the same day.
Delivered within 48/72 working hours from the time we confirm it has left. If the order is confirmed after 2:00 p.m. it will be shipped the next working day.
If an item is not in stock, we will inform you at all times of the estimated date provided to us by each supplier and to which we are committed.
In the event of an incident in delivery times, you will be informed by the customer service department, always providing the best solution to the customer and the option to cancel the order if desired.

Cancellations, Returns and Withdrawals
Cancelling an order
An order can only be cancelled if it has not yet been shipped. To cancel an order, you must send an email to administracion@unicornioh.es and provide the order reference you wish to cancel.
The refund will be made using the same payment method chosen when placing the order.
Returns and commercial withdrawal. Right of Withdrawal
Withdrawal is the right of a consumer of a good to return it to the store within a legal period, without having to state or give any explanation in this regard or suffer a penalty.
According to the regulations, the consumer and user will have the right to WITHDRAW from the contract during a maximum period of 14 calendar days without having to indicate the reason and without incurring any costs, except those provided for in art. 107.2 and 108 of RD1/2007, of November 16, which approves the aforementioned text of the General Law for the Defense of Consumers and Users.

Disclaimer of liability
UnicornioH is not responsible for any effects that may be caused by the use of insoles for ballet pointe shoes if they are necessary. To avoid errors in the pointe test, it is important that you bring the insoles or prosthesis that you are using at all times. It is likely that some pointe shoes will be unusable if you change the insole or prosthesis with which you have done the test.
Due to its characteristics, the product does not include support or assistance services for its use. UnicornioH is exempt from the responsibility of providing this service, although to the extent possible we always try to provide support for any questions.
UnicornioH assumes no liability arising from the misuse of products purchased on our site and, more specifically, UnicornioH is exonerated from all liability for any risk or loss, personal or otherwise, that may occur as a direct or indirect consequence of the misuse of any product purchased on this website. This does not apply to a fault or factory defect in the product, in which case UnicornioH is obliged to remedy the problem by refunding the amount or sending a new product.
UnicornioH assumes no responsibility for the decision to purchase any of the products acquired, and this decision is entirely at the discretion and responsibility of the customer.
This website also contains links to other websites that are not operated by UnicornioH (hereinafter, the "Related Sites"). UnicornioH has no control over the Related Sites and therefore does not accept any responsibility for them or for any loss or damage that may arise from your use of them. Your use of the Related Sites will be subject to the terms and conditions of use and service contained in each of these websites.
After-sales service and guarantees
Due to the nature of the items we sell, we do not have an after-sales service as such, although we try to resolve all your queries.
All products have a two-year legal guarantee. In the event of defects or faults, the full amount paid will be refunded.

The user acknowledges and accepts that the entire website, including, but not limited to, texts, articles, images, designs, software, content (including structure, selection, arrangement and presentation thereof), audiovisual material and graphics, is protected by trademarks, copyrights of UnicornioH and other legitimate registered rights, in accordance with international treaties to which Spain is a party and other property rights and laws of Spain.

UnicornioH reserves the right to modify, at any time, the presentation and configuration of the website, as well as these General Conditions.
For this reason, UnicornioH recommends that all users read them carefully each time they access the website. Contractors of any of the services offered on this website will always have the General Conditions in a visible place, freely accessible for any queries they may wish to make.
In the event that any clause of these General Conditions is declared void, the other clauses will remain in force and will be interpreted taking into account the will of the parties and the purpose of these General Conditions.
UnicornioH may not exercise any of the rights and powers conferred in this document, which shall not in any case imply the waiver of the same, except for express recognition by UnicornioH or prescription of the action that corresponds in each case.
Applicable law and jurisdiction
These Terms of Use are governed by Spanish law. These Terms of Use are subject to the provisions of Law 7/1998, of April 13, on general contracting conditions, Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, Law 7/1996, of January 15, on the Regulation of Retail Trade, and Law 34/2002, of July 11, on information society services and electronic commerce.
In accordance with article 29 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, contracts concluded electronically in which a consumer is a party shall be presumed to have been concluded in the place where the consumer has his or her habitual residence. Therefore, in the event of a dispute arising from these general conditions and for the resolution of conflicts, the parties submit to the courts and tribunals of the User's domicile.
Likewise, electronic contracts between entrepreneurs or professionals, in the absence of an agreement between the parties, will be presumed to have been concluded in the place where the service provider is established.
